1. Agreement to Terms
By accessing or using UKWebMail's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.
These Terms constitute a legally binding agreement between you and UKWebMail Ltd (company number 03456789), registered at Floor 3, Innovation House, 45 Colmore Row, Birmingham B3 2AA ("UKWebMail", "we", "us", "our").
2. Services
UKWebMail provides email hosting services including, but not limited to, email accounts, webmail access, calendar synchronisation, and related features as described on our website and in your chosen plan.
3. Account Registration
To use our services, you must:
- Be at least 18 years old or have parental/guardian consent
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your information if it changes
- Accept responsibility for all activities under your account
You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access to your account.
4. Acceptable Use
You agree not to use our services to:
- Send spam, unsolicited bulk email, or messages that violate applicable laws
- Distribute malware, viruses, or other harmful code
- Engage in phishing, fraud, or identity theft
- Harass, threaten, or abuse others
- Violate intellectual property rights
- Distribute illegal content or engage in illegal activities
- Attempt to gain unauthorised access to our systems or other accounts
- Interfere with or disrupt our services
- Resell our services without authorisation
We reserve the right to suspend or terminate accounts that violate these terms without notice.
5. Payment and Billing
Free Trial: New accounts receive a 14-day free trial. No payment is required during the trial period. At the end of the trial, you must enter payment details to continue using the service.
Subscription: Services are provided on a subscription basis, billed monthly or annually as selected. Payments are due in advance.
Price Changes: We may change prices with 30 days' notice. Price changes do not affect the current billing period.
Refunds: Annual subscriptions may be refunded on a pro-rata basis within 30 days of initial purchase. Monthly subscriptions are non-refundable.
Late Payment: If payment fails, we will attempt to collect payment again. After 7 days of failed payments, your account may be suspended. After 30 days, your account may be terminated.
6. Service Level Agreement
We commit to 99.9% service availability, measured monthly (excluding scheduled maintenance). If we fail to meet this target, you may request account credit equal to 10% of your monthly fee for each 0.1% below target, up to a maximum of one month's fees.
Scheduled maintenance will be notified at least 48 hours in advance via email and our status page, except in emergencies.
7. Data and Privacy
Your use of our services is also governed by our Privacy Policy. You retain ownership of all content you upload or create using our services. You grant us a limited licence to store, process, and transmit your content as necessary to provide our services.
8. Your Email Address
Your @ukwebmail.com email address is provided for the duration of your subscription. You are responsible for:
- Keeping your account credentials secure
- Using your address in accordance with these terms
- Not using your address for spam or illegal activities
- Maintaining an active subscription to keep your address
9. Intellectual Property
UKWebMail and its logos, designs, and content are our property and protected by intellectual property laws. You may not use our trademarks without written permission.
You retain ownership of content you create or upload. We do not claim any ownership rights over your content.
10. Limitation of Liability
To the maximum extent permitted by law, UKWebMail shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Actions of third parties
Our total liability for any claim shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold UKWebMail harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
12. Termination
By You: You may cancel your subscription at any time through your account dashboard. Your service will continue until the end of the current billing period.
By Us: We may suspend or terminate your account immediately for violation of these Terms, illegal activity, or non-payment. We may also terminate with 30 days' notice for any reason.
Effect of Termination: Upon termination, your right to use our services ends. We will retain your data for 30 days to allow export, after which it will be deleted.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through our website at least 30 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
15. Entire Agreement
These Terms, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and UKWebMail regarding our services.
